Marketable and authorised biocidal Products

Biocidal products may be made available on the German market and used in the following cases:

  • on the basis of transitional measures during the approval procedure of the contained active substance(s) (Article 89(2) of Regulation (EU) No 528/2012 (Biocidal Products Regulation) in conjunction with section 28(8) of the German Chemicals Act and  the Biocide Law Implementation Ordinance);
  • due to continued transitional measures during an ongoing decision-making process on an application for authorisation submitted in due time (Article 89(3) subparagaph 2 of the Biocidal Products Regulation in conjunction with section 28(8) subparagraph 3 of the German Chemicals Act and the Biocide Law Implementation Ordinance)
  • if they are already authorised (Article 17(1) of the Biocidal Products Regulation).

Transitional measures

Information on biocidal products that may be made available on the market and used on the basis of the transitional measures is compiled in the relevant section for the Biocide Law Implementation Ordinance (ChemBiozidDV).

After approval of all active substances contained in a biocidal product biocidal products may continue to be made available on the market and used on the basis of transitional measures, provided that an application for authorisation is submitted in due time and the evaluating competent authority has not yet taken a decision on it. The requirements, such as notification of the product under the transitional measures and regular confirmation of this notification, continue to apply, but must be supplemented by information on the case number and date of submission of the product authorisation application. In addition, these products are summarised in a list which we provide on this page.

Authorised biocidal products

Information on biocidal products authorised in Germany and other European member states is compiled in the "Information on biocides" database on the website of the European Chemicals Agency (ECHA).
